EMPLOYMENT LITIGATION

Campbell Soup

On March 20, 2025, Fitapelli & Schaffer, LLP filed a class and collective action lawsuit against Campbell Soup Company and Snyder’s-Lance Inc. (collectively “Campbell Soup”). The lawsuit alleges that Campbell Soup misclassified its Production Supervisors as exempt from overtime pay, resulting in unpaid wages in violation of the Fair Labor Standards Act (“FLSA”) and Wisconsin state labor laws.

The lawsuit claims that Production Supervisors at Campbell Soup regularly worked 14.5 to 15-hour shifts, often exceeding 40 hours per week, without receiving proper overtime compensation. Despite their job titles, these supervisors primarily performed non-exempt duties, such as operating production machinery, assisting hourly workers, and troubleshooting breakdowns, making them eligible for overtime pay under federal and state law.

Affected workers may include all current and former Production Supervisors employed by Campbell Soup nationwide in the last three years. The lawsuit seeks to recover unpaid overtime wages, liquidated damages, and other compensation for these workers.

If you worked for Campbell Soup, or a similar company in the food manufacturing industry, make sure you are being paid correctly under the Fair Labor Standards Act and state labor laws. Unfortunately, this industry is notorious for misclassifying workers to avoid paying overtime.
