Berry Bros Contractors Sued for Unpaid Overtime

Posted by: Brian Schaffer

Berry Bros General Contractors, one of the largest construction service providers in the United States, has just been sued over failing to pay its employees the proper wages. There are a significant number of potentially affected employees throughout the nation working on projects for Berry Bros in Pennsylvania, West Virginia, North Carolina, South Carolina, Mississippi, Louisiana, Texas, Oklahoma, New Mexico, Kansas, Colorado, Wyoming, Montana, and North Dakota. Affected job titles include mechanics, electricians, welders and other laborers with similar job titles.

Although these laborers are considered non-exempt employees, meaning they are not exempt from receiving overtime pay, Berry Bros has allegedly kept their rightfully earned wages from them when working over 40 hours in a work week. Under the Fair Labor Standards Act, laborers were wrongfully denied their overtime compensation at 1.5 times their regular rate of pay. Specifically, Berry Bros did not factor in all compensation it paid its laborers when calculating the regular rate of pay for purposes of calculating and paying overtime. As a result, Berry Bros has significantly underpaid its non-exempt laborers for overtime hours worked.

If you or anyone you know has worked for Berry Bros in the last several years, they may be eligible to join this case and potentially recover owed wages. Call Fitapelli & Schaffer, LLP at (212) 300-0375 for more information or visit our website.
